JOB CANDIDATE DATA PRIVACY NOTICE

This Data Privacy Notice explains how we, Proxiad Bulgaria EAD, UIC  175108293, with headquarters and management address at 13 B Tintyava Str., 4th floor, Sofia, part of Proxiad Group, use your personal data and what are your rights and options in this respect. It applies to personal data that you provide to Proxiad Bulgaria when using our online career resources available in section “Careers” on our website or which is derived from such data as part of the recruitment process.

How we use information that is gathered by cookies or other web-tracking or analytics technologies is explained in our Privacy Policy. Please, consult our Privacy Policy (https://bulgaria.proxiad.com/privacy-policy/) for any details regarding the processing of your personal data in connection with your visits and/or common use of our website.

Please note that where this notice explains applicable law and your rights, this applies only to personal data which is processed under the European Union General Data Protection Regulation (Regulation (EU) 2016/679) (the “GDPR”). Where the processing of your personal data is not subject to this regulation or where additional country-specific data protection law applies, different rules may apply.

WHO IS RESPONSIBLE FOR YOUR PERSONAL DATA?

Proxiad Bulgaria EAD will typically be the responsible data controller in respect of any personal data collected and processed for selection- and- recruiting-related purposes.

HOW WE COLLECT YOUR PRESONAL DATA? WHAT TYPES OF DATA DO WE COLLECT?

We will typically collect your personal data directly from you when you apply for a vacant job position or internship, upload your resume into our database,  participate in job interviews, sign up for our career newsletter, or interact with us in any other way   in pursuit of joining our team. We do not obtain personal data from third parties except where you have utilised the services of a recruitment agency or a third party website. We may carry out background checks as part of the recruitment process that may include checking publicly available social media activity if necessary and relevant to the position.

When using our online career resources, you will be asked to provide certain information which contains personal data. If you do not provide us with this information, we will not be able to assess your candidacy. We collect the following information about and from you:

First name, last name, email address required for completing the application form; Personal details  that you  at your sole discretion included in your CV attached to the application form; information collected during the interview process such as name, age, gender, education, qualification, skills, work experience, references and other information relating to your employment history. Please, be informed that we only collect information relevant to the selection criteria.

We may create information relating to you during the recruitment process including: interview notes, evaluation test results, reports.

WHAT PURPOSES DO WE USE YOUR PERSONAL DATA FOR AND WHAT IS THE LEGAL BASIS FOR PROCESSING YOUR DATA?

We use your personal information for the purposes of facilitating the entire job application procedure, both selection and recruitment process, on the grounds of our legitimate interests , in particular for assessing your suitability for the position, to communicate with you, to deal with disputes and accidents and take legal or other professional advice. Please, note that in order to   eventually hire you we shall also use your information to comply with legal and regulatory requirements under the applicable laws. We shall rely on your consent to send you our career newsletter, to invite you to meetings and other events, as well as to retain your personal data in our data base for longer periods. Please, note that when you upload your resume into our database you authorize us to store your data for a period longer than 6 months as prescribed by the law. We will use the data in order to offer you future positions/internship we think you are suitable for.

Where we rely on our legitimate interests as a legal basis for processing your personal data, we did consider your potential interests, fundamental rights and freedoms. We did balance your interests, rights and freedoms against our interests, taking into account the purposes of the processing, the security of your data and our relationship with you. Based on this balancing test and with our efforts to inform you in a very transparent way of the processing activities, we are of the opinion that processing your data does not materially impact any of your interests, rights and freedoms.

We  will not use your personal data for purposes that are incompatible with the purposes listed in this Privacy Notice, unless it is required or authorized by law, or it is in your own vital interest (e.g. in case of a medical emergency) to do so.

We will process your health data and other sensitive data if required to do so under the applicable law and (1) to consider whether we need to provide appropriate adjustments during the recruitment process and to ascertain your fitness to work; (2) to comply with any legal or regulatory obligation.

SHARE OF YOUR PERSONAL DATA

We will only share your personal information within the Proxiad Group of companies, partners, contractors and/or service providers of Proxiad Bulgaria for the purposes of managing the selection and recruitment process, human resources administration activities,  maintenance, improvement and optimization of our website, as well as for the purposes of conducting our main business activities.

These data recipients are legally or contractually obligated to protect the confidentiality and security of your personal information and data. We have the right to disclose your personal data and information to the competent authorities in the cases and under the conditions set forth in the applicable laws.

HOW LONG DO WE STORE PERSONAL DATA?

We will retain your personal information for the duration of the selection and recruitment procedure or longer if permissible under the applicable data protection laws. If you are successful in applying for a position, your personal information will be retained for a further period for the purposes of implementing of the employment contract.

The right to be informed 

We are publishing this Privacy Notice to keep you informed as to what we do with your personal data. We strive to be transparent about how we use your data.

The right to accessYou have the right to access your information. Please contact us at the contact details listed below if you wish to access the personal information we hold about you.
The right to rectificationIf the information we hold about you is inaccurate or incomplete, you have the right to ask us to rectify it. If these data have been passed to a third party, then we must also ask them to rectify the data. Please contact us if you need us to rectify your information.
The right to erasureIf you want us to erase all your personal data we have about you and we do not have a legal basis to continue to process and hold it, we shall do that upon your request.
The right to restrict processingYou have the right to ask that we restrict the way we process your data. This means that we are permitted to store the data but not further process it. We will keep just enough data to make sure we respect your request in the future. If you want us to restrict the processing of your data, please contact us.
The right to data portabilityWe shall allow you to obtain and reuse your personal data for your own purposes in a safe and secure manner without this affecting the usability of your data. This right only applies to personal data that you have provided to us which we hold based on your consent or for the purposes of the performance of a contract.

The right to withdraw consentIf you have given us your consent to process your data (e.g. by subscribing to receive our career newsletter) but change your mind later, you have the right to withdraw your consent at any time. Please note that the withdrawal of consent does not affect the lawfulness of processing of your personal data on the basis of the consent given before withdrawal.
